  Grandma's Button Box ~ Terms

In order to make this work we need to agree on some important issues.  Please read this page very carefully.  I have tried to very hard to make everything very easy to understand and as a protection for all of us.  We want to make our customers happy as well as making some money.  If you decide to join us, you are joining a "family" a community of creative craftsman.  Please do not join us if you are not willing or able to be a giving member ~ we do not want any "prima donna" members.  I neither have the time nor the desire to deal with people who can not get along and are not willing to put the community needs ahead of their own. 

Commission sales agreement
*This is an agreement  between you (the crafter) and Grandma's Button Box, a division of Among Country Friends (the selling agent).  Whereas the crafter wishes to market his/her products and whereas the selling agent is prepared to sell the products on behalf of the crafter in return for a commission.
*There is nothing in this agreement that constitutes a partnership between the crafter and the selling agent. 
*The selling agent is an independent contractor and does not have the authority to assume or create any obligation for the crafter beyond the sell of the products listed on the website. 
*There are no representations, warranties, guarantees, conditions, terms or collateral contracts affecting the transaction contemplated in this agreement except those that are stated in this agreement.
*The seller is not responsible for any copyright infringements by the crafter. 
*The selling agent cannot and will not accept any liability that results from the display, offering for sale, sale or delivery of your goods through the Site. Therefore, you agree to defend, indemnify and hold harmless the selling agent or any other related entity, from and against any and all demands, claims, actions, causes of action, liabilities, suits, proceedings, investigations or inquiries, or any settlement thereto, and all related expenses, including, but not limited, to all litigation expenses (including reasonable attorneys' fees and court costs) and settlement amounts, as well as all special and consequential damages and damage to Grandma's Button Box goodwill and reputation that arises from or in connection with the display, sale, transfer or use of your goods displayed upon or acquired through the Site. 

Selling rights & responsibilities
            
Crafter
*The crafter grants the selling agent a non-exclusive right to sell his/her products on the website www.grandmasbuttonbox.com 
*The crafter has the right to expect the selling agent to do her best to promote sells by maintaining the website and aggressive marketing.  
*The crafter has the right at anytime to have his/her products taken off of the website.  Send an email or written request for removal of products, list the products to be removed.  They will be removed usually within 48 hours.  An explanation would be appreciated, but not required.
*With a valid reason the crafter has the right to refuse to sell a product to a specific individual.
*The crafter has the right to be paid in a timely manner and to receive monthly reports about his/her products.
*The crafter has the right to either agree to or decline any product special requests that the selling agent passes on to him/her.
*The crafter has the right to participate or not participate in any special promotions that the selling agent offers on the website.
*The crafter has the right to expect confidentiality in all business matters.
*The crafter has the right  to expect loyalty and honesty from the selling agent.
*The crafter should not encourage visitors to purchase directly from her the products that she lists on Grandma's Button Box.  The selling agent is entitled to her commission.

  
Selling agent
*The selling agents will do her best to promote sells by maintaining the website and aggressive marketing.  
*The selling agent has the right to choose which crafters and products will be placed on the website.
*The selling agent may amend this agreement from time to time.  The changes will be posted on this page of the website.  It is the crafter's responsibility to periodically check for changes.  The selling agent will send out an email informing the crafter of any major changes, for example fees or policy changes.
*The selling agent has the right to remove products that violate any of the product guidelines.
*The selling agent has the right to remove a crafter at any time, with or without a reason.  An email will be sent to the crafter notifying him/her of removal.  Childish behavior, inferior products, unwillingness to cooperate and not meeting your obligations will not be tolerated.
*Upon removal of a crafter the selling agent will not be liable to the crafter for compensation, damages or reimbursement beyond what is owed the crafter for previous unpaid sells.
*The selling agent has the right to expect loyalty and honesty from the crafter.

Selling responsibilities 
Product Guidelines
*All products must be of the highest quality workmanship.
*All products must be handcrafted, no foreign imports will be allowed.
*Supplies, antiques, vintage, "treasures", etc. will be accepted if they fit in with country and/or prim decorating and crafts.  
*No patterns will be allowed with the exception of patterns by Connie Sherlock, owner of Grandma's Button Box. Among Country Friends and Son Shine Seed Co.
*The crafter must have permission from the designer to sell any finished product from his/her pattern and must give credit to the original designer.
*All products must be approved by the selling agent. 
*All products must be family oriented, no nudity, pornographic, illegal or otherwise offensive to the selling agent and the general public.
*All products, with the exception of special orders and personalize products, must carry a money back guarantee if the buyer is not satisfied with the product.

Pricing
*The crafter will set the selling price (which includes the 25% commission to the selling agent).  
*The selling agent agrees to sell the product at the price set by the crafter, with the exception of unfair pricing.  If the price is intended to undercut the price of a similar product, or is much lower than the prices set by other crafters, the selling agent will inform the crafter of the situation.  If they are not able to reach an agreement the selling agent has the right to refuse the product.
*Shipping & handling charges will be set by the crafter.  Be sure that the amount you charge will be enough to cover your cost to any state.  If you are shipping internationally contact the selling agent for more information.  ****this is an area we are still working on, 

Orders & shipping
*The selling agent will take all orders from the website and send an email to the crafter.
*The crafter will ship the order to the buyer, within the time frame and as described in the product listing.
*Buyer will pay all shipping and handling charges.
*Ship all orders according to buyer's preference with insurance, confirmation of receipt (USPS) and/or tracking # (UPS). Package the product well to minimize damage.
*Email selling agent as soon as product is shipped so we will know when it was shipped and how it was shipped.
*The crafter will handle any problems between himself/herself and the buyer.  The selling agent is available to help with all problems and will try to resolve the problem to the satisfaction of the crafter and the buyer, but ultimately is it the responsibility of the crafter.
*We want customer satisfaction so on rare occasions when we get a request for a refund we will honor it (excluding special orders, personalized, etc.) and give a refund of the product price (less shipping & 10% restocking fee).  With the exception of product damaged in shipment, the product must be shipped back in acceptable resalable condition to receive a refund.
*The 10% restocking fee will be used to cover the expenses of the selling agent, for example credit card fees, etc.

Commission and crafter payments
*The selling agent prefers to handle all of the payments by paypal but if this is not acceptable for the crafter other arrangements will be made.
*The selling agent will receive a commission of 25% of the selling price, not the shipping charges or taxes.
*When the order is shipped the crafter will be paid 40% + shipping costs.
*With confirmation from the buyer that the product has arrived you will be paid the other 35% to your paypal account.
*If this goes well and we all get very busy I will have to change payments schedule to payments on the 1st and 15th of each month.
*Refunds - when the crafter notifies the selling agent that the product has been returned to him/her in resalable condition the selling agent will refund the buyer for the price of the product minus the shipping cost and a 10% restocking fee.:  
*The crafter will reimburse selling agent the price of the product minus shipping cost.
   *the crafter will always be paid the shipping cost.
   *if the crafter has any money coming from the selling agent the refund will be deducted from that money.
   *if the crafter is not owed any money at the time of the refund, he/she will pay the product price minus the shipping to the selling agents paypal account.
